What is a trademark?
Trademarks are an important intellectual property asset. A trademark is any word, phrase, symbol, design or a combination of the above that serves to identify the source of your products or services. A trademark can be a brand name, business name, slogan, tagline or logo. It sets your products or services apart from that of other companies and brands.
Why do I need a trademark?
You may very well already have a trademark. But, the question is have you protected your trademark? You acquire trademark rights by actually using your mark in connection with your products or services. However, federal registration of your trademark provides the following benefits: 1) presumption of ownership; 2) presumption of the exclusive right to use the trademark nationwide; 3) ability to record trademark with U.S. Customs to prevent infringers from importing counterfeits; 4) right to bring legal action in federal court; 5) the right to use the ® symbol in connection with your trademark; and 6) the ability to sell your product in the Amazon marketplace.
How can I own a trademark?
People often talk about "buying" a trademark. But, you cannot actually "buy" a trademark. You can, however, obtain the exclusive right to use a trademark in connection with your products or services by actually using the trademark in connection with your products or services. Nonetheless, if you want to obtain the legal right to exclusively use your trademark nationwide in connection with the products or services you provide, you have to file for federal registration of the mark with the United States Patent and Trademark Office (USPTO).
Do trademarks ever expire?
Trademarks rights have the potential to never expire! That means trademark rights can last in perpetuity if trademark registration is properly maintained. In order to maintain your trademark registration, you must file trademark maintenance documents, and the corresponding fees, after the 5 - 6 year and 9 - 10 year of use and then every ten years thereafter. Failure to timely submit the required maintenance documents and fees will result in the expiration or cancellation of your trademark registration.
